Bodog Entertainment Group, S.A. and 1st Technologies LLC faced each other in a Las Vegas district court for the first time last week. Chief Judge Roger L. Hunt ruled on several points.
Bodoglife.com will go on, but may never regain control of its previous domains. In addition, the $49 million default judgment against Bodog was upheld.
The default judgment, according to Bodog founder Calvin Ayre, was illegitimate because Ayre he never received notice of the patent infringement lawsuit and thus could not respond to it. Hunt rejected this argument and allowed the judgment to stand. Ayre plans to appeal.
As for the motions filed by 1st Technology for a permanent injunction against Bodoglife continuing to operate in what 1st Technology calls patent infringements, Hunt declined to rule for the plaintiff. “Plaintiff [1st Technology] failed to adequately address the four-prong test that would satisfy the burden to obtain a permanent injunction,” according to Judge Hunt’s written decision.
