Pennsylvania attorney Lawrence Burns responded to Part Time Poker’s request for information about the preliminary hearing in his “luck vs skill” poker case scheduled for November 28:
I waived my right to a preliminary hearing but preserved my right to file pre-trial motions in the defense of my case.
My formal arraignment will be on January 25. 2008 with pre-trial motions to be filed within 30 days of that date if all discovery has been obtained.
Burns is arguing against District Attorney John Peck, who believes that poker is a game of “chance,” while Burns believes that as poker requires skill, it does not meet the definition of gambling in Pennsylvania, and that criminal charges should be dropped, as well as his poker winnings returned.
