Nevada teachers’ union casino tax petition challenged by casinos

As previously reported, the Nevada State Education Association is pushing for a casino tax increase to help fund Nevada’s struggling schools. Nevada casinos are pushing back, and the Nevada Resorts Association has filed a lawsuit challenging the union petition.
A hearing on the challenge has been scheduled for January 18 by presiding judge Miriam Shearing, who has previously rejected a similar petition. However, her 2001 vote to remove the NSEA-sponsored petition to increase taxes for the benefit of the schools was based on a technicality involving the number of concepts legally allowed in a petition, and not on the concept itself.
The current petition would have to survive the legal challenge, collect enough signatures, and make it through the voting process of 2008 and 2010 before it could take effect.
